What Is Alimony?

Spousal maintenance, or alimony, are payments made from one spouse to another in the aftermath of a divorce. First, let us say that not all divorces come to an end with alimony payments attached. However, if one spouse has been economically dependent on the other spouse’s income throughout the marriage, there will likely be alimony involved.

The court can rule that the spouse who is better off financially must pay the spouse of lesser means. There are various forms that these payments may take:

  • Temporary alimony: This could be awarded by the court to be paid while the divorce proceedings are ongoing and may or may not lead to other forms of alimony.
  • Bridge-the-gap and rehabilitative alimony: This type of alimony is focused on helping the receiving spouse transition to a path where they are able to support themselves and may last while the spouse gets a degree or vocation training of some sort.
  • Durational alimony: This is typically awarded for shorter marriages and will not last longer than the marriage lasted.
  • Permanent alimony: This type of alimony is long-term and awarded to help the spouse with lesser means maintaining a lifestyle they were accustomed to during the duration of the marriage.

There Are Two Sides

There have been debates over the years in Florida to end lifetime alimony requirements, including in 2019. There are two sides to this:

  • Many women who receive alimony have no other way to survive and support the continued lifetime requirements ordered in some cases.
  • Many men who make alimony payments argue that the system is unfair, that they should not be on the line forever, and that they have trouble getting modifications if they themselves hit hard times.

*Around 98 percent of those who receive alimony are women.
