Man faces attempted murder felony charge in Florida

A 66-year-old Florida man is currently being held without bond due to an alleged altercation he had with a neighbor that resulted in a reported shooting. The neighbor involved in the incident suffered critical wounds by gunshot at the time of the alleged squabble. The dispute is said to have been caused over dog  droppings. The jailed man now faces a felony charge.

The neighbor was reported to have been walking his dog on a recent Saturday night. The man accused of the shooting allegedly witnessed the animal preparing to defecate on his son's lawn. According to witnesses, a loud argument then ensued between the two men. Witnesses also informed police that the man who was walking the dog threatened a fight with the other man.

The man who is now in jail stated that he saw a shiny object in the hand of the dog owner. This, he said, prompted him to rush to his own vehicle and retrieve a firearm that was contained inside the glove compartment. Reports suggest that the man with the gun opened fire. The other man was wounded and transported to a hospital in critical condition. Updated reports list him as recovering after having undergone several surgeries with another expected.

In court, the defendant's attorney made it known that the other man was listed as the aggressor in the case on the police affidavit. He suggested that his client's charge be changed to second-degree attempted murder rather than first-degree so that he could be released on bond. He further argued that his client had responded to a justified fear and was merely taking action to protect himself against a threat. As in this case, any person accused of a felony crime in Florida is entitled to be represented in court by a legal advocate who has experience in these types of cases.
