Nicholas Brendon faces felony charge over alleged misconduct

Florida fans of the television show "Buffy the Vampire Slayer" may have heard about the arrest of one of the stars of the show. Nicholas Brendon was recently arrested in Florida for suspected criminal mischief and grand theft. As he is facing a felony charge, he will need to proceed carefully in order to protect his rights.

The 43-year-old actor, who more recently had a long stint on "Criminal Minds," was reportedly in the area for a comic book convention. He has been accused of drinking and causing roughly $450 worth of damage to his hotel room. He was reportedly found sleeping in a car belonging to one of the employees of the hotel. It is suggested that he refused to pay outstanding charges, which is what led to his arrest.

He was arrested in Oct. 2014 for similar misconduct. In 2010, he was arrested for resisting arrest, vandalism and battery of a police officer. He went to rehab after that particular incident. Prior to that, he was in rehab in 2004. 

In cases such as this one in which the accused parties have histories of alcohol or drug abuse, it may be possible to negotiate plea deals with Florida prosecutors. A possible plea deal could consist of agreeing to lesser charges in exchange for attending a court-mandated drug and alcohol rehabilitation program. Dependent upon an individual's criminal history and current situation, it may be possible to have all charges dropped upon completion of the rehab program. Ultimately, one wants to make sure his or her rights are fully protected when facing a felony charge, including the right to a fair trial and the presumption of innocence.
