Altercation in grocery checkout lane leads to felony charge

A 53-year-old Florida man received a felony battery charge for punching a 58-year-old man in a grocery store lane on Dec. 1. As a result of the altercation, the alleged victim was knocked unconscious and put into a coma. The accused man's felony charge could potentially be upgraded if the victim's condition becomes worse.

The incident took place at the M & L Food Market in Miami Beach and was captured by store surveillance cameras. While the men were both standing in a checkout lane designated for small purchases, the 58-year-old proceeded to tell the 53-year-old that he was in the wrong lane. However, the younger man continued to unload his groceries while an argument ensued. When the 53-year-old backhanded the 58-year-old man, he fell and hit his head on the floor.

Following the incident, the 53-year-old allegedly fled the scene while the victim was taken to Ryder Medical Center with severe brain bleeding. He was later moved to Jackson Memorial Hospital where he remains in a coma. When the accused man was taken into custody in Palm Beach ten days later, he reportedly admitted that he was involved in the altercation.

A person who has received a felony battery charge could face severe penalties if they are convicted. To avoid receiving the maximum sentence, an individual might wish to seek help from a criminal defense attorney. A legal professional could help the defendant arrange a plea deal that allows them to plead guilty to a lesser charge. If the prosecution's case against the defendant is weak, an attorney might dispute the charge by presenting contradictory evidence.
