Uncontested Divorce
An uncontested divorce is the preferred way of ending a marriage. If couples can agree on all divorce-related issues prior to filing, they can move through the divorce process quickly and cost-effectively. At The Law Office of Gustavo E. Frances, a flat fee of $1,500 covers an uncontested divorce minus the applicable filing fees.
In Florida, a divorcing couple with children must take a parenting class to proceed with an uncontested divorce. Otherwise, the process is generally very simple and straightforward, and many couples are able to finalize their divorce decree in as little as two weeks.
Contested Divorce
In some situations, even an uncontested divorce can become a contested divorce, when issues such as child support, child custody and alimony cannot be resolved. If circumstances lead the divorce to become contested, I will apply the flat rate towards the retainer.
Alimony/Spousal Support
Alimony is based on the need and ability of a spouse to pay. Such an amount can be negotiated between soon-to-be former spouses. In Florida, there are different types of alimony under statute. One type of alimony the state courts can enforce is "bridge-the-gap" alimony. This type of alimony attempts to place the former spouse on equal footing as the other.
Which type of alimony is appropriate for a situation largely depends on the length of a marriage. Short-term marriages are those less than seven years. In these situations alimony is not usually appropriate unless you can show an exceptional circumstance. Moderate-term marriages are those more than seven years but less than 17 years. Those marriages longer than 17 years are often given permanent alimony.
